fresh killsIn an effort that has stretched nearly a decade, some families of 9/11 victims have fought to have the remains of their relatives identified and put to rest.

In 2002, they organized as the WTC Families for Proper Burial Inc. They sued the city in 2005, then appealed after they lost in 2008.

On Wednesday, in a spirited hearing interrupted occasionally by gasps, a three-judge panel of the United States Court of Appeals for the Second Circuit listened to arguments on behalf of the 17 plaintiffs in what is quite likely their final legal chance. The families seek to have nearly one million tons of material from Fresh Kills on Staten Island, where debris from the World Trade Center collapse was taken, moved to a nearby site so it can be sifted and put in a cemetery.

“It comes down to this: Are we prepared to leave hundreds of body parts and human remains on top of a garbage dump?” said Norman Siegel, the lawyer for the plaintiffs, arguing that to do less would deprive relatives of their constitutional rights.

The group of plaintiffs, which says it has support from 1,000 other relatives, was challenging a July 2008 decision by Judge Alvin K. Hellerstein of Federal District Court, who found that city workers had done everything in their power to find remains.

But as it did last year, the city argues that the plaintiffs have no claims to the remains because they cannot prove they belong to their relatives, which also makes them ineligible to bring a complaint on behalf of non-family members. The removal would also be too costly, the city says.

In the hearing’s sharpest exchange, when Judge Anthony O. Calabrese Jr. asked what it would take to prove someone’s identity, James E. Tyrrell, a lawyer representing the city, said, “You have to be able to particularize and say it’s your body part.”

“All that’s left here is a bunch of undifferentiated dust,” Mr. Tyrrell added, eliciting gasps and muttered “no’s” from a crowd whose members wore laminated photos of deceased relatives around their necks.

But Diane Horning of Scotch Plains, N.J., whose son Matthew worked on the 95th floor of the north tower, said she found many trade center-related items at the landfill on dozens of trips there. She produced some of them outside the courtroom.

A corroded key, marked with the words “World Trade Center,” came from a gulley formed after a rainstorm, she said. In a plastic bag, there were two sizeable bone fragments that Ms. Horning said came from Fresh Kills, though she had never had them tested for DNA to see if they belonged to victims of 9/11.

With methane gas bubbling up from the soil there, “it’s a disrespectful, dishonorable place,” said Ms. Horning, the president of the group.

During the hearing, which was also presided over by Judge José A. Cabranes and Judge Barrington D. Parker, Mr. Siegel accused the city of reneging on its promise to set aside victims’ remains, a change in policy that he said happened in July 2002.

“They commingled it, and then they dumped it,” Mr. Siegel said of the remains’ being mixed with household trash, adding that a Fresh Kills worker had witnessed city employees use that mixture to fill potholes.

The reference brought a shake of the head from Valerie Speller, who was there to honor her brother John Candela, who worked in the north tower.

“I think the whole thing’s pretty deplorable,” Ms. Speller said after the hearing. “I don’t think there was any human compassion from the city.”

John R. Moffett, the distinguished neuroscientist and managing editor of OPEDNEWS, has brought his considerable prestige to bear on the issue of whether the Twin Towers and WTC7 were destroyed by controlled demolition using the incendiary and sometimes explosive thermite as a key component. Unfortunately, he has done so with either malicious incompetence, or worse, a cynical deliberate determination to distort, conceal, and suppress the findings of a recently published scientific article, “Active Thermitic Material Discovered in Dust from the 9/11 World Trade Center Catastrophe,” that dispositively proves the presence of unignited explosives in the WTC dust. Neither motivation on Dr. Moffett’s part obviously recommends him for his post at OPEDNEWS. I will first address Dr. Moffett’s smear http://www.opednews.com/articles/Was-it-Nanotech-Thermite–by-John-R-Mof…, which was promoted to OPEDNEWS headline status on 4/15/2009, then the importance of the thermitic dust. If you think that 911 isn’t your issue, you should pay close attention.

The evidence that first brought me around to considering 911 as a USG covert operation was the National Aeronautics and Science Administration’s (NASA’s) publication of a thermal survey taken September 16, 2001, that showed ground temperature hot spots of 1,100 and 1,400 degrees Fahrenheit. Such temperatures are far too high to be produced by an open-air hydrocarbon fire except in very short bursts, but certainly not as an enduring after-effect. Students of 911 have collected a vast array of evidence that temperatures at the WTC were generated far in excess of what normal hydrocarbon fires could produce. The evidence includes eyewitness testimony of molten iron or steel weeks after the event, videos of orange molten metal pouring from the South Tower minutes before its destruction, and microspheres of once-molten iron in the dust examined by the United States Geological Survey forensics team (without further comment or analysis!).

The importance of iron microspheres is simple. Iron melts around 2,800 Fahrenheit, which is about twice the highest temperature that an open-air fire could produce. A microsphere can only be produced by first melting iron, then dispersing the melted iron by some energetic means (like explosion) into an aerosol whose particles, influenced by the surface tension of the molten metal, form spheres as the smallest surface area required to contain any specified volume of matter. Once again, as with the NASA thermal survey, an intense source of energy other than the WTC fires is required to melt iron or steel, as even the National Institute of Standards and Technology (NIST) admitted in its reports. The science is pretty simple; only its political consequences are complicated, and troubling.

Spanish AG: No torture probe of US officials

MADRID (AP) — Spain’s attorney general has rejected opening an investigation into whether six Bush administration officials sanctioned torture against terror suspects at Guantanamo Bay, saying Thursday a U.S. courtroom would be the proper forum.

Candido Conde-Pumpido’s remarks severely dampen the chance of a case moving forward against the Americans, including former U.S. Attorney General Alberto Gonzales. Conde-Pumpido said such a trial would have turned Spain’s National Court “into a plaything” to be used for political ends.

“If there is a reason to file a complaint against these people, it should be done before local courts with jurisdiction, in other words in the United States,” he said in a breakfast meeting with journalists.

Spanish law gives its courts jurisdiction beyond national borders in cases of torture, war crimes and other heinous offenses, based on a doctrine known as universal justice, but the government has made clear it wants to rein in the process.

Last month, a group of human rights lawyers asked Judge Baltasar Garzon, famous for indicting ex-Chilean ruler Augusto Pinochet in 1998, to consider filing charges against the six Americans. Under Spanish law, the judge then asked prosecutors for a recommendation on whether to open a full-blown probe.

National Court prosecutors have not formally announced their decision, but Conde-Pumpido is the country’s top law-enforcement official and has the ultimate say. While an investigative judge like Garzon is not bound by the prosecutors’ recommendation, it would be highly unusual for a case to proceed without their support.

A senior court official told The Associated Press that a formal announcement would come Friday. He said prosecutors would stop short of an outright call for dismissal of the case, but would raise a series of legal objections that would make it impossible for it to proceed in its current form.

He spoke on condition of anonymity because he was not authorized to talk to the media.

Coming less than three months after the Bush administration left office, the case was the first of several international efforts to indict former administration officials. Human rights groups have also tried to bring suit against Bush officials in a German court.

In addition to Gonzales, the complaint named ex-Undersecretary of Defense Douglas Feith; former Vice President Dick Cheney’s chief of staff, David Addington; Justice Department officials John Yoo and Jay S. Bybee; and Pentagon lawyer William Haynes.

It alleged that the men — who have become known as “The Bush Six” — cleared the path for torture by claiming in advice and legal opinions that the president could ignore the Geneva Conventions, and by adopting an overly narrow definition of which interrogation techniques constituted torture.

But Conde-Pumpido rejected that argument, saying the case had no merit because the men did not themselves commit the alleged abuses.

“If one is dealing with a crime of mistreatment of prisoners of war, the complaint should go against those who physically carried it out,” Conde-Pumpido said.

Gonzalo Boye, one of the human rights lawyers who brought the case in Spain, said the decision by Conde-Pumpido was politically motivated and set a terrible course for Spanish justice.

“The attorney general speaks of the court being turned into a plaything. Well, I don’t think the attorney general’s office should be turned into a plaything for politicians,” Boye told AP. “It is a terrible precedent if those intellectually responsible for crimes can no longer be held accountable.”

The court official told AP that in addition to raising legal doubts, prosecutors will say that Garzon should be replaced by another judge who is already investigating whether secret CIA flights to or from Guantanamo entered Spanish airspace or landed at Spanish airports.

Such a move would make it difficult for Garzon to try to keep the case alive despite prosecutors’ objections, as he did in the Pinochet case.

Observers say the removal of Garzon would be another serious blow for the hopes of human rights lawyers, who saw him as being sympathetic to their cause.

Most of the American officials named in the case have remained silent since the allegations first surfaced in March. Feith, however, has called Spain’s claim of jurisdiction “a national insult with harmful implications.”

Former President George W. Bush has steadfastly denied the U.S. tortured anyone. The U.S. has acknowledged that Khalid Sheikh Mohammed, the self-described plotter of the Sept. 11 attacks, and a few other prisoners were waterboarded at secret CIA prisons before being taken to Guantanamo. But the Bush administration insisted that all interrogations were lawful.

Spanish prosecutors have decided to press forward with a criminal investigation targeting former U.S. Attorney General Alberto Gonzales and five top associates over their role in the torture of five Spanish citizens held at Guantánamo, several reliable sources close to the investigation have told The Daily Beast. Their decision is expected to be announced on Tuesday before the Spanish central criminal court, the Audencia Nacional, in Madrid. But the decision is likely to raise concerns with the human-rights community on other points: They will seek to have the case referred to a different judge.

The six defendants—in addition to Gonzales, Federal Appeals Court Judge and former Assistant Attorney General Jay Bybee, University of California law professor and former Deputy Assistant Attorney General John Yoo, former Defense Department general counsel and current Chevron lawyer William J. Haynes II, Vice President Cheney’s former chief of staff David Addington, and former Undersecretary of Defense Douglas J. Feith—are accused of having given the green light to the torture and mistreatment of prisoners held in U.S. detention in “the war on terror.” The case arises in the context of a pending proceeding before the court involving terrorism charges against five Spaniards formerly held at Guantánamo. A group of human-rights lawyers originally filed a criminal complaint asking the court to look at the possibility of charges against the six American lawyers. Baltasar Garzón Real, the investigating judge, accepted the complaint and referred it to Spanish prosecutors for a view as to whether they would accept the case and press it forward. “The evidence provided was more than sufficient to justify a more comprehensive investigation,” one of the lawyers associated with the prosecution stated.

Nationally syndicated conservative radio host Michael Reagan called for the murder of a political activist on June 10. Reagan, a frequent guest on cable news shows and the son of President Ronald Reagan, singled out 9/11 activist Mark Dice by name and called several times for his assassination.

Reagan had learned that political activists had reportedly been sending letters and DVDs to troops in Iraq, advancing the theory that the U.S. government had carried out the September 11, 2001 attacks. For promoting this unpopular view, the talkshow host advocated that these activists should be killed as “traitors”:

We ought to find the people who are doing this, take them out and shoot them. Really. You take them out, they are traitors to this country, and shoot them. You have a problem with that? Deal with it. You shoot them. You call them traitors, that’s what they are, and you shoot them dead. I’ll pay for the bullets.

Even more troubling was the call for violence against a specific individual: “How about you take Mark Dice out and put him in the middle of a firing range. Tie him to a post, don’t blindfold him, let it rip and have some fun with Mark Dice.”

Reagan subsequently had Dice on his show (6/16/08) as a guest and stated, “I’m sorry for what I said.” As an explanation, Reagan offered, “Sometimes radio hosts we get fired up and angry and we say things that are actually stupid, and we make mistakes.”

Reagan’s “mistakes,” unfortunately, have repeatedly involved advocating murder to his audience. On August 15, 2006, Reagan called for violently killing babies who were reportedly being named for the Lebanese militant group Hezbollah and Hezbollah’s leader, Hassan Nasrallah:

Naming their children ‘Hezbollah.’You know what I’d get ‘em for a first birthday? I’d put a grenade up their butts and light it. Happy birthday, baby. Bye bye.

In response to a caller who pointed out that children are not responsible for the names they are given, Reagan repeatedly asserted, “So what’s wrong with killing the mothers and the babies?”

In response to the arrest of a 9/11 demonstrator during a Bill Clinton appearance in Corpus Christi, corporate media shill and former Republican Congress critter Joe Scarborough and his co-hosts demanded 9/11 truthers be tasered and taken to detention camps. “Where’s the taser?” Joe wants to know as MSNBC runs footage of the man’s arrest. “Tase him!” His co-host adds: “Led away in handcuffs and hopefully taken to one of those secret prisons in eastern Europe and never to be heard from again… I hope we have a special prison for 9/11 conspiracy theorists.”

In other words, the corporate behemoth MSNBC believes people who disagree with the government not only do not deserve First Amendment rights and protection, but also believe demonstrators should be kidnapped by the CIA and taken to a “special prison” to be tortured and ultimately killed, as this is the fate many who disappear suffer.

Is it possible the United States is about to become like Pinochet’s Chile? In 1973, thanks to the CIA and U.S. corporations, Chile became a brutal police state. Chileans were subjected to systematic and massive violations of their most basic human rights. Official figures indicate that nearly 3,000 people were executed, disappeared or lost their lives as a result of torture and political violence. It would seem “Morning Joe” would enthusiastically welcome the installation of a fascist state where those he disagrees with are disappeared, tortured, and murdered.

Last October, CNN host Glenn Beck called 9/11 truthers “insane” and “dangerous anarchists” in response to 9/11 truthers infiltrating the Real Time with Bill Maher show. “These truthers are exactly the kind of people who want to rock this nation’s foundation, tear us apart and plant the seeds of dissatisfaction in all of us… [this is] the kind of group a Timothy McVeigh would come from,” declared Beck, setting a precedence followed this morning by the scurrilous Joe Scarborough and his complaisant minions.

“In thousands of 9/11 protests over the course of the last six years, not one person has been arrested for violent conduct,” Steve Watson wrote at the time. “To cart blanches suggest that the truth movement is dangerous, ‘a threat to children’ and intent on violence is extremely inflammatory and indicates just how afraid of investigating and debating the facts people like Glen Beck actually are.”

The core of the 9/11 truth movement is composed of highly educated and progressive individuals who are strictly opposed to violence and are intent on protecting a free and peaceful society which has been under dire threat ever since the attacks of 9/11 and the ensuing cover up.

Furthermore the movement represents the very antithesis of anarchism in that it is actively seeking to restore and protect our traditional form of government which has been usurped by an unaccountable cabal that continues to operate outside of Constitutional law and with little restraint using 9/11 as justification.

Indeed, Beck and Scarborough are calling for such draconian measures simply because the 9/11 truth movement is comprised “of highly educated and progressive individuals who are strictly opposed to violence” and because of this they must be demonized as a threat to national security and thus the government must kidnap, torture, and murder them. Although Scarborough did not suggest 9/11 truth “idiots” be murdered, this is of course the ultimate fate of those who oppose militarized fascism, now gaining speed in the United States.

Just who are these suspected terrorists that President Bush seeks a blank check to spy on? Recent reports in USA Today indicates that the government’s terrorist watch list has swelled to 755,000 names. In December of 2005 NBC News reported that a secret Defense Department document listed a Quaker Meeting House gathering of anti-war activists as a “threat.”

“This peaceful, educationally oriented group being a threat is incredible,” says Evy Grachow, a member of the Florida group called The Truth Project.

… the Pentagon now collects domestic intelligence that goes beyond legitimate concerns about terrorism or protecting U.S. military installations, say critics.

In December 2005 the ACLU published a press release: New Documents Show FBI Targeting Environmental and Animal Rights Groups Activities as ‘Domestic Terrorism’

The ACLU said that some of the documents suggest infiltration by undercover “sources” at animal rights meetings and conferences.

At times, the documents show aggressive attempts by the FBI to link PETA, Greenpeace and other mainstream organizations to activists associated with the Animal Liberation Front (ALF) or Earth Liberation Front (ELF), said the ACLU. PETA, in particular, is repeatedly and falsely singled out as a “front” for militant organizations although in at least one document released today the FBI appears to acknowledge that it has no evidence to back up such assertions.

Equally disturbing, on November 8, 2007 CSPAN aired a hearing of the Homeland Security Subcommittee’s “Terrorism and the Internet.” These hearings purported to identify “home grown terrorist recruiters” on the internet, in connection with House Bill HR 1955, “Violent Radicalization and Homegrown Terrorism Prevention Act of 2007.”

The FBI now keeps a list of over 900,000 names belonging to known or suspected terrorists, the American Civil Liberties Union said today.

If that number is accurate, it would be an all-time high, exponentially more than the 100,000 names on the list several years ago. But the number needs to be taken with a grain of salt: after all, the ACLU doesn’t keep the list, the FBI does, and the bureau doesn’t generally like to talk about it. (Indeed, the FBI has not yet responded to a request for comment for this post.)

But if the ACLU’s figure isn’t accurate, it’s also unlikely to be off by that much. Last September, the ACLU notes, the Department of Justice’s Inspector General reported the FBI watch list was at 700,000 names, and growing at 20,000 names per month.

The ACLU says they “extrapolated” from those figures to determine the list’s current size. ACLU’s Barry Steinhardt added that the group had spoken privately with people familiar with the watch list, who told them the 900,000 figure was not outlandish.

In the past, The FBI has told ABC News that the size of its watch list is classified. Despite that, both the bureau and the DoJ Inspector General have published the total figure in unclassified reports.

There’s no doubt the FBI’s list is growing: just last June, ABC News reported it was at 509,000 names, based on information in an unclassified FBI budget document.

But strangely, the list may be growing not because of swelling legions of foreign terrorists. Instead, it appears the FBI may be adding tens of thousands of names belonging to U.S. persons it suspects of being domestic terrorists — people who have no known ties to international terrorist organizations.

A separate entity, the National Counterterrorism Center (NCTC), keeps a list of all names believed to belong to terrorists linked to international terror groups. That list, which was at 100,000 names in 2003, grew to 465,000 names by last June – but since then has grown only modestly, according to NCTC spokesman Carl Kropf. Today, Kropf said that list stands at roughly 500,000 names. (Unlike the FBI, the NCTC does not maintain that the size of its watch list is classified information.)

The FBI takes that list and adds to it a new collection of names which belong to U.S. persons believed to be domestic terrorists: people who have links to terrorism but not to any international group.

Last June, the NCTC was responsible for putting 465,000 names on the watch list, and the FBI appeared to add an additional 44,000. By September, extrapolating from the DoJ Inspector General’s report, the FBI’s contribution appears to have grown to somewhere north of 200,000 names.

Today – if the ACLU is to be believed – the FBI’s contribution may be as high as 417,000 names. Which would raise a new question: Where are so many domestic terrorists coming from? Or do they simply use more aliases than foreign terrorists?

Update: The FBI responded late Wednesday afternoon. Spokesman Chad Kolton did not dispute the ACLU’s figure, but noted that the watch list contains names, aliases and name variations for individuals. The number of people on the watch list, he said, was around 300,000, and only 5 percent are U.S. persons. Kolton noted that the list is “regularly reviewed for accuracy.” Last year the bureau removed 100,000 records “related to people cleared of any nexus with terrorism,” Kolton said.

bush_-_hitler.jpgI was born the very day World War II ended. My fellow postwar “Baby Boomers” grew up on old black and white documentaries of that war and the events leading up to it. But those films never really answered the most important question, a question that has nagged me, and I suspect most of my generation

How did Germany and the German people become the Mrs. O’Leary’s cow of an entire continent? How could a culture, re-formed during the Renaissance, create a horror like Auschwitz?

How does something that extraordinary happen? It’s a question that has not only burdened American Baby Boomers, but three generations of postwar Germans as well. But for them it’s much more than just a historical curiosity. For postwar Germans it’s also been a nagging sense of collective guilt – guilt about events they had nothing to do with, but guilt nonetheless. It’s a guilt built on the realization that their parents and grand parents either participated in, supported and/or enabled what happened over half a century ago — or, at the very least, did nothing to prevent or stop it.

Of course the fascist rulers of the Third Reich ruled with a heavy hand. So it’s not hard to understand why so many Germans simply laid low rather than oppose the regime.

“Nazi terror from above and the demise of the rule of law started just a few days after Hitler’s assumption of power in January 1933. The penalties of opposition became higher and higher. In the first nine months alone, at least 100,000 people, most of them leftist Germans, were thrown into hastily erected concentration camps. Others ended up in ordinary prisons and many died. Countless more were roughed up by rampaging brownshirts in broad daylight or taken into police custody on trumped-up political charges. By 1936, a brutal police state had penetrated virtually all spheres of life.” ( New York Times books.)

While the rules have tightened here since 9/11, we’ve not experienced anything near that scale. Speaking out is remains a survivable exercise.

Which begs the question; what will be our excuse? How will we explain the things we’ve allowed this administration to get away with — the torture, the “renditions,” the secret prisons, the warrant-less wiretapping, the lies we and our media allowed to stand? What are we going to tell our grand children when they ask us what the hell we were thinking, feeling and doing while all that was afoot?

I understand it’s against the rules of polite society to recklessly throw the “f” word around by comparing anything that’s happening today to the kind of atrocities that occurred under Hitler. It”s even worse to compare any contemporary American political/religious/social leader to Hitler.

So I won’t. I won’t go that far, because it hasn’t gone that far – yet.

Did the NSA’s massive call records database program pre-date the terrorist attacks of 9/11?

That startling allegation is in court documents released this week which show that former Qwest CEO Joseph Nacchio — the head of the only company known to have turned down the NSA’s requests for Americans’ phone records — tried, unsuccessfully, to argue just that in his defense against insider trading charges.

qwest.jpgNacchio was sentenced to 6 years in prison in 2007 after being found guilty of illegally selling shares based on insider information that the company’s fortunes were declining. Nacchio unsuccessfully attempted to defend himself by arguing that he actually expected Qwest’s 2001 earnings to be higher because of secret NSA contracts, which, he contends, were denied by the NSA after he declined in a February 27, 2001 meeting to give the NSA customer calling records, court documents released this week show.

AT&T, Verizon and Bellsouth all agreed to turn over call records to an NSA database, according to reporting in the USA Today in 2006. At that time, Nacchio’s lawyer publicly stated that Nacchio declined to participate until served with a proper legal order.

The government has never confirmed or denied the existence of the program, but is trying to win legal immunity for telecoms being sued for their alleged participation in the call records program and the government’s warrantless wiretapping of Americans. Turning over customer records to anyone, including the government, without proper legal orders violates federal privacy laws.

A shocking KSLA news report has confirmed the story we first broke last year, that Clergy Response Teams are being trained by the federal government to “quell dissent” and pacify citizens to obey the government in the event of a declaration of martial law.

hitleratchurch.jpgIn May 2006, we exposed the existence of a nationwide FEMA program which is training Pastors and other religious representatives to become secret police enforcers who teach their congregations to “obey the government” in preparation for the implementation of martial law, property and firearm seizures, mass vaccination programs and forced relocation.

A whistleblower who was secretly enrolled into the program told us that the feds were clandestinely recruiting religious leaders to help implement Homeland Security directives in anticipation of a potential bio-terrorist attack, any natural disaster or a nationally declared emergency.

The first directive was for Pastors to preach to their congregations Romans 13, the often taken out of context bible passage that was used by Hitler to hoodwink Christians into supporting him, in order to teach them to “obey the government” when martial law is declared.

It was related to the Pastors that quarantines, martial law and forced relocation were a problem for state authorities when enforcing federal mandates due to the “cowboy mentality” of citizens standing up for their property and second amendment rights as well as farmers defending their crops and livestock from seizure.

It was stressed that the Pastors needed to preach subservience to the authorities ahead of time in preparation for the round-ups and to make it clear to the congregation that “this is for their own good.”

Pastors were told that they would be backed up by law enforcement in controlling uncooperative individuals and that they would even lead SWAT teams in attempting to quell resistance.

Though some doubted the accuracy of this report at the time due to its fundamentally disturbing implications, the story has now been confirmed by a KSLA 12 news report, in which participating clergy and officials admit to the existence of the program. View video here.

What kind of a sick bastard would write such a thing?

A bastard so sick of how splintered we are politically – thanks mainly to our ineptitude in Iraq – that we have forgotten who the enemy is.

It is not Bush and it is not Hillary and it is not Daily Kos or Bill O’Reilly or Giuliani or Barack. It is global terrorists who use Islam to justify their hideous sins, including blowing up women and children.

Iraq has fractured the U.S. into jigsaw pieces of competing interests that encourage our enemies. We are deeply divided and division is weakness.

Most Americans today believe Iraq was a mistake. Why?

Not because Americans are “anti-war.”

Americans have turned their backs because the war has dragged on too long and we don’t have the patience for a long slog. We’ve been in Iraq for four years, but to some it seems like a century. In contrast, Britain just pulled its soldiers out of Northern Ireland where they had been, often being shot at, almost 40 years.

WEST TERRE HAUTE Two men walking across the nation to protest the Iraq war say police officers in West Terre Haute violated their constitutional rights last week when one of the men was arrested for failing to produce identification.

Police say the request for identification was legitimate, and the arrest lawful.

For nearly four months, Raymond Schwab, 32, of Loveland, Colo., and Elliott Nesch, 22, of Fort Collins, Colo. — Brother Raymond and Brother Elliott, to their followers — have been walking from Denver on their way to Washington, D.C., sharing their religious and pacifist beliefs.

They belong to Beit Shalom Ministries, an outreach of the Protestant Free Church Movement, according to their Web site, www.beitshalomministries.org, which is sponsoring the walk.

On the evening of July 8, the two had just crossed the border from Illinois into Indiana when Nesch was stopped by a West Terre Haute police officer.

That in itself is not unusual for the pair.

Nesch said during an interview Friday afternoon that since they began walking, they have been stopped daily by members of various police agencies.

But this week was the first time either of the two ended up in a jail cell.
